However, the regulation also provides that when operating an aircraft within another country, the pilot licence issued by that country may be used.

As the accident flight started in Germany and its destination was in Spain, and considering that PART-FCL licences are valid in the territories of the states included in their scope of application, which include Germany and Spain, we consulted the FAA to obtain their opinion on the applicability of the exception in this specific case.

The FAA responded that the licence held by the pilot met the requirements of the CFR Part 61.3."
