Guten Morgen
Hatte vor einigen Woche die selbe Frage und mich via eAPIS support schlau gemacht.
Summary: Es braucht KEIN Visum. Zwischen den USA und BAhamas besteht eine Sonderregelung. Das ESTA reicht für die Wiedereinreise.
Die genaue Details / Antwort lautete:
Hi, Timo,
There are general provisions for non-signatory carriers to carry certain VWP travelers to and from contiguous territories (Mexico and Canada) and/or adjacent islands (see list below) – if the traveler is returning from one of these places within their VWP admission period (and meet all other applicable requirements).
This guidance is general in nature – not a specifc pre-determination of admissibility. The CBP Port of Entry shall make the final admissibility decision upon arrival.
It’s very important to communicate to the CBP port of entry when requesting permission to land to establish the traveler is applying for:
READMISSION (revalidation of the I-94 within 90-days of the initial admission date) to the United States, and
NOT an initial ADMISSION under the Visa Waiver Program.
More information about readmission from a contiguous territory or adjacent Islands can be found in the Code of Federal Regulations (CFR) at 8 CFR 217.3, but here’s the specific citation you need:
(b) Readmission after departure to contiguous territory or adjacent island . An alien admitted to the United States under this part may be readmitted to the United States after a departure to foreign contiguous territory or adjacent island for the balance of his or her original Visa Waiver Pilot Program admission period if he or she is otherwise admissible and meets all the conditions of this part with the exception of arrival on a signatory carrier.
Applications for VWP Signatory Carrier Status can be made through VWP@cbp.dhs.gov .
Note: The term, “adjacent islands” is defined in 8 CFR 286.1:
§ 286.1 Definitions.
The following definitions apply to the following terms in this part:
(a) The term adjacent islands means Anguilla, Antigua, Aruba, Bahamas, Barbados, Barbuda, Bermuda, Bonaire, British Virgin Islands, Cayman Islands, Curacao, Dominica, the Dominican Republic, Grenada, Guadeloupe, Haiti, Jamaica, Marie-Galante, Martinique, Miquelon, Montserrat, Saba, Saint Barthélemy, Saint Christopher, Saint Eustatius, Saint Kitts-Nevis, Saint Lucia, Saint Maarten, Saint Martin, Saint Pierre, Saint Vincent and Grenadines, Trinidad and Tobago, Turks and Caicos Islands, and other British, French and Netherlands territory or possessions bordering on the Caribbean Sea.
Ich hoffe, das hilft. Wir gehen diesen Sommer. Mit ESTA und OHNE Visum von Orlando auf die Bahamas und zurück.
Gruss
Timo
